Welcome to The Widow Maker Outdoors. These Terms of Service ("Terms") constitute a legally binding agreement between you and The Widowmaker Outdoors LLC, a Montana limited liability company ("Company," "we," "us"), governing your access to and use of our websites, mobile applications, and services (the "Services"). By creating an account or using the Services you agree to be bound by these Terms and our Privacy Policy.
IMPORTANT NOTICE REGARDING MINORS: The Services are designed to be family-friendly and intended for use by youth and beginner hunters under parental supervision. Users under 18 may use the Services only with the involvement and consent of a parent or legal guardian, as described in Section 15 and our Privacy Policy. By permitting your child to use the Services, you agree to these Terms on their behalf.
You must be at least 13 years of age to create an account, and users under 18 must have verifiable parental consent as described in Section 15. You must provide accurate, current, and complete information during registration and keep it updated. Accounts are non-transferable.
The Services provide tools for hunting, fishing, and outdoor activities, including GPS mapping and navigation using USGS imagery and BLM public land boundary data, hunting and fishing season information, trip planning, harvest logging, real-time hunting party location sharing, educational content for youth and beginner hunters, and opt-in wildlife observation logging that may contribute to conservation data programs with state and federal wildlife agencies.
WE DO NOT GRANT ANY LEGAL RIGHTS. Information provided by the Services — including land ownership boundaries, public land designations, seasons, regulations, and access information — is for general informational and educational purposes only. It is your sole responsibility to verify all applicable laws, regulations, seasons, bag limits, license and tag requirements, and land access rights with the relevant state wildlife agency and land management authority before hunting, fishing, or accessing any land. Boundary and regulation data may be inaccurate, outdated, or incomplete, and must never be relied upon as legal authority. Trespassing is a crime.
You are responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
(a) Some features may require a paid subscription; by purchasing one you authorize us (through third-party payment processors such as Stripe) to charge applicable fees on a recurring basis until cancellation.
(b) Subscriptions automatically renew unless cancelled; cancellation takes effect at the end of the current billing period.
(c) Except where required by law, fees are non-refundable; we may offer refunds at our discretion.
(d) We may change fees with reasonable prior notice.
(e) Chargebacks filed without first contacting support may result in account suspension until resolved.
(f) Beta program participants may receive free or lifetime access as a courtesy; beta access features are provided "as is," may change or be discontinued, and confer no ownership or permanent entitlement beyond what we expressly grant in writing.
You agree NOT to: use the Services for any illegal purpose or in violation of any hunting, fishing, firearms, trespass, or wildlife regulation; hunt, fish, or access land based solely on app information without independent verification; share account credentials to avoid fees; scrape or harvest the Services' data or build a competing product; upload unlawful, harassing, or infringing content; share another user's real-time location with third parties without consent; impersonate any person or government entity; interfere with the Services; or use the Services unsafely while operating a vehicle or firearm.
You retain ownership of content you submit (harvest logs, photos, journal entries, observations). By submitting content, you grant the Company a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display it within the Services and in connection with promoting the Services. You represent you have rights to content you upload. Wildlife observation data may, if you opt in, be shared with state or federal wildlife agencies for conservation purposes. Harvest data is yours; we will never sell your personal harvest records.
Real-time location sharing within a hunting party is voluntary, visible only to party members you invite, and can be stopped at any time. Do not rely solely on the app for safety or emergency communication — it depends on cellular coverage, battery life, and GPS accuracy, all of which can fail in the field. Always carry appropriate navigation and communication equipment.
The Services, including software, map configuration, educational content, logos, design, and text, are owned by The Widowmaker Outdoors LLC or its licensors. "The Widow Maker Outdoors" and associated marks are the property of the Company. You receive a limited, revocable, non-exclusive license for personal, non-commercial use. All rights reserved.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We specifically do not warrant that: map imagery, land boundaries, or ownership data are accurate or current (boundary data is a general reference only and does not constitute legal boundary determinations); season dates or regulations are complete or current; GPS location data will be accurate or available; the Services will be uninterrupted or error-free; or educational content constitutes formal hunter education, certification, or legal advice.
HUNTING, FISHING, AND BACKCOUNTRY ACTIVITIES ARE INHERENTLY DANGEROUS. You assume all risks associated with outdoor activities, including firearms handling, wildlife encounters, weather, terrain, and remote medical care. Nothing in the Services constitutes safety, survival, or firearms instruction, and the app must never replace proper hunter education, local knowledge, sound judgment, or applicable law.
TO THE MAXIMUM EXTENT PERMITTED BY MONTANA LAW, THE COMPANY AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM USE OF THE SERVICES, INCLUDING RELIANCE ON MAP, BOUNDARY, SEASON, OR REGULATION DATA, OR GPS FAILURES. Our total aggregate liability for all claims will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) one hundred dollars ($100). Nothing in these Terms limits liability that cannot be limited by law.
You agree to indemnify, defend, and hold harmless The Widowmaker Outdoors LLC and its owners, employees, and contractors from claims, damages, and expenses (including attorneys' fees) arising from your use of the Services, your violation of law including hunting, fishing, or firearms laws, your content, or your violation of these Terms.
You may stop using the Services and delete your account at any time. We may suspend or terminate access for Terms violations, legal requirements, or service discontinuation (with pro-rata refund of prepaid fees where applicable).
These Terms are governed by Montana law. Disputes will, where permitted, be resolved by binding arbitration in Montana on an individual basis (not as a class action). If arbitration is unavailable, disputes resolve in Montana state or federal courts. YOU AND THE COMPANY WAIVE THE RIGHT TO A JURY TRIAL AND CLASS ACTIONS. Nothing here prevents either party from seeking injunctive relief for intellectual property infringement.
We may update these Terms; material changes will be communicated in-app or by email at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
If we learn we have collected personal information from a child under 13 without verifiable parental consent, we will delete it. Parents may review, correct, or delete their child's information and refuse further collection by contacting Dalton.DeMars@thewidowmakerhuntinggps.com.
The Services use third-party data and infrastructure (USGS, BLM, Esri/ArcGIS, Google, payment processors, hosting providers). We are not responsible for third-party content or availability.
If any provision is unenforceable, the remainder stays in force. Our failure to enforce is not a waiver. No agency, partnership, or joint venture is created.
